61. KOL's primary defence is that Minister Tsolo, lacked the authority to conclude the arbitration agreement and supply agreement. KOL alleges that the arbitration agreement has been declared void ab initio by the Lesotho High Court, and this would constitute a good defence.
17. FSG’s argument on authority is that: 17.1 Minister Tsolo had actual authority to conclude the Arbitration Agreement because of section 10 of the Lesotho Government Proceedings and Contract Act 4 of 1965. Mr Nathane KC, a senior advocate in the Kingdom, confirms that this is so.
